Another Court Holds Texts are covered under 227(c)

Short one today.

Another District Court in Texas held that text messages are actionable for TCPA DNC claims.

Here's the case and quote:

Callierv. Reovations Unlimited LLC, 2026 U.S. Dist. LEXIS 180385, at *20 (W.D. Tex. Aug. 12, 2026) (“Ultimately, the Court’s interpretation aligns with the weight of authority, confirming that text messages are actionable under § 227(c)(5).")

The Court recognized that decisions have come down on both sides of this question but ultimately it went the right way. Texas is shaping up to be a strong battleground for TCPA plaintiffs.

By my count, this makes roughly the thirty-first or thirty-second order post-McLaughlin holding texts are actionable under the TCPA.
